Terms of Service

1. About these terms
These Terms of Service (“Terms”) govern your use of Asermu, a web-based writing application operated by Carlos Diaz, a sole trader based in England (“we”, “us”, “our”).
By creating an account or using Asermu, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the service.
2. The service
Asermu is an offline-first writing suite. Your creative content (manuscripts, characters, locations, timelines, plot threads, notes, and encyclopedia entries) is stored locally in your browser's IndexedDB. We provide server-side services for authentication, subscription management, and optional cloud backup.
Because your content is stored locally, you are responsible for maintaining your own backups. Clearing your browser data, switching browsers, or reinstalling your operating system may result in data loss. We provide export tools (project vault, PDF, EPUB, Markdown) to help you back up your work.
3. Accounts
- You must be at least 16 years old to create an account.
- You are responsible for keeping your login credentials secure.
- You must provide accurate information when registering.
- One person may hold one account. Creating multiple accounts to circumvent usage limits is not permitted.
4. Plans and pricing
4.1 Free tier
The Free tier includes the manuscript editor, character profiles, locations, and timeline, with one project and no word count limits. Additional modules (plot grid, notes, encyclopedia) and more projects are available on paid plans. We reserve the right to adjust free tier limits with 30 days' notice.
4.2 Writer and Pro subscriptions
Writer and Pro are recurring subscriptions processed by Stripe. Current prices are listed on our pricing page.
- Subscriptions auto-renew at the end of each billing period unless you cancel.
- You can cancel at any time from your account page. Cancellation takes effect at the end of the current billing period — you retain access until then.
- If you downgrade, your content is preserved but may become read-only if it exceeds the lower tier's limits.
4.3 Lifetime plan
The Lifetime plan (one-time payment, see pricing pagefor current rates) grants Pro-tier access for the lifetime of the Asermu product. “Lifetime” means for as long as Asermu continues to operate as a product, not the lifetime of the purchaser. This includes all features available at the time of purchase and all features added in the future.
4.4 The “Forever Yours” promise
If Asermu ceases operation, we will release standalone installers (Windows, macOS, Linux) so that all offline features continue to work without a server. Cloud-dependent features (such as automatic cloud backup) would stop, but your local tools and data remain yours. This commitment applies to all Lifetime buyers and is a binding part of these Terms.
5. Refunds and cancellation
5.1 Subscriptions (Writer and Pro)
You can cancel your subscription at any time. You will retain access until the end of your current billing period. We do not provide partial refunds for unused time within a billing period.
If you are a UK consumer, you have a statutory 14-day cooling-off period from the date of each subscription renewal under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. By using the service during this period, you consent to immediate performance and acknowledge that you may lose your right of withdrawal. If you have not used the service during the cooling-off period, contact us for a full refund of that renewal.
5.2 Lifetime plan
Because the Lifetime plan provides immediate access to digital content, the 14-day cooling-off period under the Consumer Contracts Regulations 2013 may not apply once you begin using the service. If you contact us within 14 days of purchase and have not used the service, we will issue a full refund.
5.3 EU/EEA consumers
If you are a consumer in the EU or EEA, you have a 14-day right of withdrawal from the date of purchase. To exercise this right, contact us at [email protected] with your account email and purchase date. If you have begun using the digital content during the withdrawal period, you acknowledge that you may lose the right of withdrawal, but we will consider refund requests on a case-by-case basis.
6. Content ownership
You retain full ownership of everything you create in Asermu. We do not claim any intellectual property rights over your content. We do not use your content to train machine learning models. We do not read your content.
You grant us a limited licence to process your data solely to provide the service — for example, to relay your project vault to Google Drive when you use cloud backup. This licence ends when you delete your account.
7. Acceptable use
You agree not to:
- Use the service for any unlawful purpose
- Attempt to gain unauthorised access to the service or other users' accounts
- Interfere with or disrupt the service or its infrastructure
- Create multiple accounts to circumvent usage limits
- Resell or redistribute access to the service
8. Availability and changes
We aim to keep Asermu available at all times, but we do not guarantee uninterrupted access. We may modify, suspend, or discontinue features with reasonable notice. For material changes that reduce functionality you have paid for, we will provide at least 30 days' notice.
9. Limitation of liability
To the maximum extent permitted by law:
- Asermu is provided “as is” without warranty of any kind.
- We are not liable for any loss of data stored locally in your browser. You are responsible for your own backups.
- Our total liability for any claim arising from your use of the service is limited to the amount you have paid us in the 12 months preceding the claim, or £100, whichever is greater.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded under English law.
10. Dispute resolution
We hope to resolve any disputes informally. If you have a concern, please contact us at [email protected] first. If we cannot resolve the matter, the courts of England and Wales have exclusive jurisdiction, and these Terms are governed by the laws of England and Wales.
If you are a consumer in the EU, you may also use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
11. Changes to these terms
We may update these Terms from time to time. If we make material changes, we will notify you by email or by posting a notice in the app at least 30 days before they take effect. Continued use of the service after the effective date constitutes acceptance of the revised Terms.
